why for this skill is not checkbox present instead of radiobutton? I think should be possible enable/disable use this skill. its not stance, its ability. so why cant be used with berserker stance?

it should look like this:

Berserker Stance and Melee Defense are both passive skills.
You can't stuck them.
And because we see the whole picture, and you don't, we have decided that it's not appropriate players to stuck skills.

As you see, they both are under the category "Battle stances"

stance = passive skill/ability. Call it as you like.

where do you think I can distinguish passive skills/battle stances (in moment of skill choosing)?

Actually passive skills for warriors are the stances.  :)
Passive skill is the skill it's activated (not casting or perform something special) once in battle and is effective for the entire battle, and when a hero is warrior usually is referred as stance.

You can check the meanings of skill/stance in wikipedia.
I am sure you'll see the common between them.

Berserker Stance gives you % bonus to damage in defense. - Meaning it boosts your damage while you're being attacked and you defend yourself - which means, that it's not an active skill.
Melee Defense gives % bonus when in the defense vs melee, but also takes from you the same % when defending yourself vs archers.

And not trying to be smartie but as far as I know, the opposite of active is passive, you know ? So you can either call it skill or stance. Whatever makes you feel better ;)

Edit: Thank you, Crassus!

Stances got brown background. Other passives (such as masteries) got green background.
