hy i'm lvl 12 and in tier 2 provinces the best shot to get a attribute stone is more likely (40-60%), and to get a sapphire is always rare(0-20%) i would like to know if in tier3 provinces this odds are higher? to know first to get lvl 20 then to mine stone, or mine stones and then get to lvl 20:P

No, odds are not higher in tier 3. Precious stones are always hard to mine unfortunately and the chance for rubies in tier 3 is also very low. So I suggest that you mine stones now :)

so in the tier3 provinces also i can mine 1-1 more likely(the best for the attribute gems) and 1-1 rare for the sapphire?
