lvl Vs. tier in castle/outpost war

Hi all, bit of complicated question,

I know that when you fight for an outpost or a castle in a T4 province, players in T5 and T3 that participate get penalized for every lvl above and below T4.
If my hero is lvl 39 (T4) and his merc is lvl 40 but also from T4 (since I can only turn him to T5 when i move to the next tier), does he get some penalties as well?

Normally they will be penalties since they are not from the proper tier. BUT since the penalty is level based calculated and the level difference is zero then the penalty is multiplied by zero... and thus the applied penalty will be zero! (aka no penalty)

There IS penalty for every level ABOVE the highest level of the corresponding tier. So, lower tier will not get penalty, but your mercs will if the attack is tier 4 for example and your mercs are 40+ levels.

Sorry but the answers were not really clear to me, if my merc is lvl 41 BUT still tier 4 (he was never upgraded - so he is level 41 but still tier 4), when fighting in a castle war will he get penalized?

As Crassus wrote the penalty is level /NOT tier/ difference based and in your case it means that your merc will suffer 2*5=10% penalty during sieges in tier 4. In other words it doesnt matter that it is still in tier 4, what matters is its level.

My answer was for tier 5 sieges... At tier 4 yes you (I mean your mercs) should suffer penalties...
